This Love Your Neighbor Project Request Agreement ("Agreement") is entered into in Lynchburg, Virginia by and between the undersigned Applicant ("Applicant") and PACE Ministries, Inc. ("PACE"), collectively referred to as the "Parties."
1. Applicant Acknowledgment
The Applicant acknowledges that he or she is voluntarily participating in a project organized by the PACE Ministries, Inc. to assist the Applicant with small repairs or sprucing up around his or her home ("Project"). The Applicant understands that participation in the Project may involve certain risks, including but not limited to injury, property damage, or other harm.
2. Assumption of Risk
The Applicant voluntarily assumes all risks associated with the Project, including any risks that may arise from the condition of the property, the nature of the work, or the actions of volunteers or third parties.
3. Indemnity
To the fullest extent permitted by law, the Applicant agrees to indemnify, defend, and hold harmless PACE, its officers, directors, employees, agents, and assigns from and against any and all claims, demands, causes of action, losses, liabilities, damages, costs, and expenses (including attorney's fees and court costs) arising out of or in connection with the Applicant's participation in the Project. This indemnity shall apply regardless of whether the claim arises from the negligence of the Applicant, PACE, or any other party.
4. Hold Harmless
The Applicant agrees to hold the PACE harmless from any and all liability for any injury, loss, or damage to the Applicant or the Applicant's property arising out of or in connection with the Applicant's participation in the Project, except to the extent such injury, loss, or damage is caused by the gross negligence or willful misconduct of the PACE or its volunteers.
5. No Employment Relationship
For purposes of the Project, the Parties agree that the PACE volunteers are not employees, contractors, or agents of the Applicant and that the volunteers are participating in the Project purely as a volunteers engaging in a charitable act without expectation of compensation or other benefits.
6. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia without regard to its conflict of laws principles.
7. Entire Agreement
This Agreement, including all information I enter into this form, constitutes the entire understanding between the Parties with respect to the subject matter hereof and supersedes any and all prior agreements, whether oral or written, relating to such subject matter.
